Exemptions From Posting

Exemptions from or waivers of posting may be granted in certain limited circumstances. The Office of Affirmative Action and Equal Opportunity Programs will determine whether a waiver of posting should be granted. See Staff Requisitioning, Recruitment, Selection, Reference Checks, Employment Offer, and Offer Letters -  Policy 101, Section 101.3 for a detailed explanation of the procedures.

105.1 EXEMPTION: ASSIMILATION INTO THE UNIVERSITY

Generally, when an external unit from another institution is assimilated into the University, the staff members employed by the unit being assimilated will be eligible for employment at the University without posting of the job requisitions for those positions. Before affected individuals can be placed on the University payroll, Human Resources will review the job requisitions of those positions to determine the appropriate job profile and grade profile.  Vacancies that occur after formal affiliation with the University will be treated in the same manner as all other University positions, and all procedures for posting and selection will apply.

105.2 EXEMPTION: CANDIDATE POOL FROM RECENT SEARCH

If a department has conducted a search for the same position (same title, job profile and grade profile) within the preceding four (4) months that resulted in a strong and diverse candidate pool, the hiring department may be eligible for a waiver of posting. Only those candidates who were part of the applicant pool generated in the prior search may be considered for the vacant position if an exemption from posting is granted.

105.3 EXEMPTION: CHANGE IN SOURCE OF FUNDING

When a position is moved to another school or center and the compensation and responsibilities remain the same, this change does not result in the creation of a new position and it is exempted from the posting requirement.

105.4 EXEMPTION: AVOID LAYOFF OF A REGULAR STAFF MEMBER

If a regular staff member whose employment would otherwise be terminated is qualified for a vacant position, the department in which the position is being created may request a waiver of posting to place the affected regular staff member into the vacant position. 

105.5 EXEMPTION: EXEMPTION: RECLASSIFICATION OF A FILLED POSITION

When a filled position is reclassified and does not result in the creation of a new position, the position is exempted from the posting requirement.

105.6 EXEMPTION: OTHER COMPELLING CIRCUMSTANCES

The University reserves the option to waive the posting of a vacant position in other very compelling circumstances (e.g., to make a reasonable accommodation for a person with a disability or the settlement of a lawsuit or grievance).
